Terms of Service

1. Acceptance of Terms

By accessing or using Filmigrate (the "Service"), located at https://filmigrate.app/ or through any authorized client, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not access or use the Service.

2. Description of the Service

Filmigrate is an interactive web application that provides world cinema tracking, 3D geographic film mapping across 255 countries, Letterboxd CSV import compatibility, multi-device cloud synchronization, and cinema challenge discovery tools.

3. User Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach. Filmigrate provides multi-device session management enabling you to revoke unauthorized active sessions at any time.

4. Merchant of Record and Payment Terms

Our order process and payment processing is conducted by our authorized Merchant of Record, Lemon Squeezy (Lemon Squeezy LLC). Lemon Squeezy handles all payment transactions, tax compliance, invoicing, and order fulfillment. When purchasing Filmigrate Pro, you agree to abide by Lemon Squeezy's Terms of Service and Privacy Policy.

5. Intellectual Property & Third-Party Services

Filmigrate Brand: The 3D globe visualization engine, UI designs, brand emblems, and software code are proprietary property of Filmigrate.
TMDB Data: Film metadata, posters, and production countries are fetched via The Movie Database (TMDB) API. This product uses the TMDB API but is not endorsed or certified by TMDB.
Letterboxd CSV Import: Filmigrate is an independent tool providing interoperability with user-exported Letterboxd CSV data files and is not affiliated with or endorsed by Letterboxd Limited.

6. User Content & Data Portability

You retain full ownership of the movie logs, watchlists, ratings, and challenge lists you create on Filmigrate. We provide 1-click JSON data export at any time in the Account Settings → Data & Export panel.

7. Fair Use Policy & Capacity Limits

To maintain high availability, prevent automated abuse, and protect infrastructure performance for all cinephiles, Filmigrate applies reasonable fair use capacity guidelines across account tiers:

Multi-Device Sync: Up to 5 concurrent devices on Annual plans, and up to 10 concurrent devices on Lifetime Founder licenses.
Cinema Library Capacity: Up to 25,000 titles on Annual plans, and up to 50,000 logged movies & watchlist entries on Lifetime Founder licenses.
Challenge Itineraries: Up to 50 active custom challenge lists on Annual, and up to 100 on Lifetime Founder.
API & Metadata Lookups: Up to 500 poster/metadata lookups per day on Annual, and up to 1,000 lookups per day on Lifetime Founder.

Accounts exhibiting automated scraping, bot activity, or commercial redistribution without prior written agreement may be subject to rate limiting or review.

8. Limitation of Liability & Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Filmigrate shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
